PARTICIPANT RELEASE, WAIVER & ASSUMPTION OF RISK

New York Dog Parade Corp. ("NYDP")

Please read carefully.

1. Participation. I am registering myself, and the dog(s) listed in my registration, to take part in the Tompkins Square Halloween Dog Parade. This may include the march, the costume competition, Parade Village and all related activities (the "Event"). I am 18 or older, or my parent or legal guardian is accepting this agreement for me.

2. Released Parties. "Released Parties" means NYDP and its officers, directors, employees, volunteers, contractors, vendors, sponsors and media partners, and their successors and assigns; and the City of New York and its agencies, including NYC Parks and NYPD.

3. Assumption of risk. I understand that the Event is held outdoors in a public park, with large crowds and many dogs close together. Its risks include, among others, dog bites, scratches, fights, jumping and knockdowns; trips and falls on uneven or wet surfaces; crowd congestion, heat, cold and weather; costume-related hazards to people and dogs; illness transmitted between animals; and loss of or damage to personal property. I understand that the Released Parties do not control, screen or supervise other participants, spectators or their dogs. I knowingly and voluntarily assume all of these risks, including the risk of others' conduct, for myself and my dog(s).

4. Responsibility for my dog. I am the owner or authorized handler of each registered dog, and I will be responsible for my dog(s) throughout the Event. Each dog is at least four months old, is vaccinated against rabies and fully vaccinated, is in good health, and has no history of aggression toward people or other animals. I will keep my dog(s) on a leash no longer than six feet and under my control at all times, and I will clean up after them. My dog's costume will not restrict its breathing, movement or vision. I will promptly report any injury, bite or incident to NYDP staff. I am solely responsible for any injury or damage my dog(s) cause to any person, animal or property.

5. Rules, registration and removal. I agree to follow all instructions from NYDP staff, volunteers, NYPD and NYC Parks personnel. Wristbands and registrations are non-transferable. NYDP may remove any participant or dog from the Event, at its sole discretion, for safety or conduct reasons. NYDP may also modify, postpone or cancel the Event for weather, safety, or any reason beyond its control.

6. Release and waiver. To the fullest extent permitted by law, I release, waive, discharge and agree not to sue the Released Parties over any and all claims for injury, illness, death, or loss of or damage to property, including to my dog, arising from my or my dog's participation in the Event. This includes claims arising from the negligence of the Released Parties, but excludes gross negligence and intentional misconduct.

7. Indemnification. I agree to indemnify and hold harmless the Released Parties from any claims, damages or costs, including reasonable attorneys' fees, arising from my actions or my dog's actions at the Event.

8. Photo and media release. The Event will be photographed, filmed and livestreamed. I grant NYDP and its media partners and sponsors permission to use my name, likeness and voice, and my dog's name and likeness, in any media and for any lawful purpose related to NYDP and its mission, without compensation or right of approval.

9. Minors. If a participant is under 18, the parent or guardian accepting this agreement does so on the minor's behalf and agrees to its terms personally. Minors must be accompanied by that adult throughout the Event, and may handle a dog only with that adult walking alongside them.

10. General. This agreement binds me, my heirs, executors, administrators and assigns. It is governed by New York law, and any dispute will be brought exclusively in the state or federal courts located in New York County. If any part of this agreement is found unenforceable, the rest remains in effect. This agreement is the entire understanding between me and NYDP about my participation.
